Dear Councilman Phillips:
I write in reference to a Sussex County government policy of which I have recently become aware, and which I believe may be unnecessarily restrictive in light of important public policy considerations. It is my understanding that, pursuant to § 2607 of the Sussex County Code, an employee of Sussex County who retires and subsequently becomes an elected official for Sussex County must either serve as an elected official without pay or waive the employee’s county pension.
After researching this issue, I have concluded that neither Kent County nor New Castle County has adopted such a broad restriction on an elected official’s right to receive a pension to which the official was otherwise entitled based on prior service in the county government. Instead, the Kent County and New Castle County codes each contain less restrictive versions of the same policy, each providing, in essence, that a former county employee who subsequently becomes a county elected official does not have to give up vested pension benefits, but if the elected official chooses not to forego the previously vested pension benefits, that official is not eligible for additional years of service or vested benefits.

IV, § 26.04.122 (Exempting elected and appointed officials from county pension restriction); Kent County Code § 83-20 (“Former employees receiving retirement benefits under this article who are elected or appointed to a statutorily defined County office shall continue to receive retirement benefits, but shall be ineligible for additional years of service or vested benefits, unless the elected or appointed official chooses to cease his/her retirement benefits, during the term of office.”). In other words, the official may keep his or her previous benefits but may not, in essence, collect double benefits from the county pension system.
In the context of state judicial pensions, the Delaware Supreme Court has noted that “it is the fundamental intent and purpose of the State pension plan to encourage qualified individuals to enter and remain in public service.”
State of Delaware EX REL. State Board of Pension Trustees et al v. Dineen,
409 A.2d 1256, 1260 (Del. Ch. Nov. 20, 1979). One can reasonably infer that the Sussex County pension plan came into being based (at least in part) on the same fundamental policy principle. I therefore respectfully request that the Sussex County Council consider amending its pension policy as it applies to former employees who become elected officials, so that it more closely resembles the less restrictive policies of Kent County and New Castle County.
